Utilisation of Illegal and Unlawful Energy

Illegal Electricity Consumption

​​​​Illegal electricity consumption is deemed to be;​

  • Consumption of electricity by the natural or legal entity through intervention on the distribution system without a retail sales contract or bilateral agreement associated with the place of use,
  • Incomplete or faulty measurement through intervention on the distribution system, meters or measurement system or on the installations from the building entry point to the meter by preventing correct determination of the consumption or without any measurement, or consumption of electricity in a way that is against the regulation by passing the electricity through a meter which has not been installed in a legal manner,
  • Reconnecting electricity which was cut off by the legal entity owning the distribution license in accordance with the relevant regulation before fulfilling the obligations without the permission of the legal entity owning the distribution license with the exception of force majeure situations.

In case a finding was determined during the conducted inspections that would lead to doubt with regards to the illegal electricity consumption, illegal electricity consumption detection process shall be initiated in line with the methods defined as per this section.​

In the detection of illegal electricity consumption, the relevant legal entity shall rely on correct findings and documents and shall not violate consumer rights. Determination of illegal electricity utilisation is required to be made at the end of this process in order to take illegal consumption action.

Legal entity owning the distribution license shall cut off the electricity of the natural or legal entities who were determined to consume illegal electricity as a result of the illegal consumption process, shall seal the meter and shall file a criminal complaint to the Public Prosecution Office.

  • In case interventions on the distribution system or measurement system or installations are determined to have been made with the purpose of preventing correct measurement of the consumption,
  • In case electricity is consumed by measuring the consumption incorrectly or less than it actually is or without ever measuring it or by passing the electrical energy through a meter which has not been installed in a legal manner,
  • In case there is a doubt that the meters do not register the consumption amounts correctly, the meters shall be removed to be replaced by a proper meter and they shall be taken for inspection.

Meter removal and installation report shall be issued. Illegal electricity consumption detection report shall be issued in case laboratory reports determine that the meter was interfered with in order to measure electricity consumption incorrectly or less than it actually is or without ever measuring it by preventing correct consumption measurement. The information on the reports shall be filled out completely and in a legible manner.​

Unlawful Electricity Consumption

Consumers are deemed to have consumed unlawful electricity in case they

  • Provide electricity to third parties from their own electricity installations after the measurement point,
  • Consume electricity without having a retail sales contract in their name by paying the bills issued in the name of the previous consumer,
  • Consume electricity without informing the relevant legal entities when the meters and measurement circuits are not sealed,
  • Connect electricity or having the connection made in a manner that would not prevent correct measurement of consumption before their connection actions required as per the relevant regulation are completed by the legal entity owning the relevant license,
  • Consume electricity outside the scope of their subscription group without making application to the relevant legal entities,
  • Fail to inform the relevant legal entities in written form within fifteen days when they change power transformers,
  • Fail to apply to the relevant legal entity owning the license when the connection power in their own facility or facilities increased more than 20% as per the relevant regulation or fail to fulfil their obligations as part of the relevant regulation despite having applied to the relevant legal entities,
  • Connect the electricity that had been cut off after fulfilling their obligations but without the permission of the legal entity owning the distribution license,
  • Fail to apply to the relevant supply company in charge to sign the retail sales contract associated with the last source supply within the time frame stipulated as part of this Regulation despite receiving electricity from the supply company in charge as part of last source supply

after they have been removed from the portfolio by their supplier while they were receiving energy as part of bilateral agreement.
